Rule 11
Cancellation of Party Registration

(1) In accordance with sub-section (1) of section 12 of the Act, a party may submit a petition to the commission as per schedule-10 by attaching the following documents to the commission in accordance with the decision made by the central committee of such party: (a) Constitution of the Party,
(b) A copy of the decision taken by the Central Committee to cancel party registration,
(c) Audit Report to be submitted to the Commission,
(d) Details of movable, immovable assets and liabilities of the parties existing before filing the application (e) Other details prescribed by the Commission.
(2) According to sub-rule (1), if an application is received for canceling the party's registration, the commission will carry out necessary investigations in this regard.
(3) According to sub-rule (2), the Commission may appoint any officer or employee of the Commission as required. The officer or employee appointed in this way must submit the report of the investigation done by him to the commission.
(4) During the investigation according to sub-rule (2) or (3), the officials or members of such committee who sign the decision of the central committee may be made to appear before the commission and get identification as per schedule-11.
(5) If the commission is convinced that a decision has been taken by the central committee of the party regarding the cancellation of the party during the investigation according to this rule, it will cancel the registration of such party.
(6) If the commission obtains the fact that the party has committed the work and action mentioned in sub-section (3) of section 12 of the Act, it may conduct necessary investigations in this regard.
(7) During the investigation according to sub-rule (6), the Commission shall give an opportunity to such party to submit a clarification by giving a deadline of fifteen days.
(8) If the party does not submit the clarification within the period as per sub-rule (7) or if the submitted clarification is not satisfactory, the Commission shall decide to cancel the registration of the party within fifteen days thereof. (9) According to sub-rules (5) and (8), the details of cancellation of party registration shall be published in the Nepal Gazette.
